Terms of Service

Welcome to DealHunter! These Terms of Service (“Terms”) govern your access to and use of DealHunter (“Service”), a real-time marketplace monitoring SaaS application operated by Echelon Dynamics Inc., a Wyoming corporation.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

To use DealHunter, you must:

• Be at least 18 years of age.
• Be a resident of the United States.
• Have the legal capacity to enter into a binding agreement.

As a user of the Service, you agree to:

• Maintain the confidentiality of your account credentials.
• Not share your account or allow others to access it.
• Provide accurate information during registration and payment.
• Not use the Service for any illegal activities.
• Notify us immediately of any unauthorized use of your account.

You agree not to:

• Distribute alerts to multiple recipients such as group emails or distribution lists.
• Engage in automated scraping, crawling, or data extraction from the Service.
• Use the Service to send spam or unsolicited messages.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Reproduce, redistribute, or resell alert data or marketplace results obtained through the Service.
• Use the Service in any manner that could damage, disable, or impair our infrastructure.
• Create additional accounts in order to obtain more of a limited feature than a single account provides.

Part of that last rule is enforced automatically, using the IP address recorded when an account is created. Sign-up is refused when an earlier account from the same network has already used up its free alert allowance, and no more than two accounts may be created from one network in any 24-hour period. Disposable and throwaway email addresses are also refused. What we store and how long we keep it is set out in our Privacy Policy.

DealHunter is available at no cost with limited usage, and on paid subscription plans. Paid plans are billed either monthly or annually; you choose the billing period when you select your plan. By subscribing, you authorize us to charge your payment method through our payment processor, Stripe, at the beginning of each billing period.

• Billing period: You choose monthly or annual billing on the plan selection screen, before you reach the checkout form; monthly is preselected. An annual subscription is billed as a single payment covering the year in advance, not in monthly installments.
• Card verification: When you subscribe for the first time, or subscribe again after a previous subscription has ended, we charge your card $1.00 to confirm it is valid and refund that $1.00 immediately. This is a real charge that we reverse, not a hold that we release, so your statement may show both the $1.00 charge and the refund, and the money typically reaches your account within 5–10 business days depending on your bank. If your card is funded in a currency other than US dollars, your bank’s exchange rate may differ between the two entries. This does not happen when you change plans on a subscription that is already running.
• Recurring charges: Your subscription automatically renews at the end of each billing period — each month for a monthly subscription, each year for an annual one — until canceled.
• Price changes: We will notify you at least 30 days in advance of any price increases. Continued use after the change constitutes acceptance.
• Failed payments: If a payment fails, we may suspend your access until payment is resolved.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until then.

A 7-day free trial is available once per account, on your first subscription. You are eligible only if your DealHunter account has never had a subscription or a trial before — including one that was canceled before it ever billed. We may also decline a trial when the payment card you present has already been used to start a trial on another account. Eligibility is determined by us at checkout; if you are not eligible, no trial is attached and your first charge is taken when you subscribe.

• A payment method is required to start the trial, and the $1.00 card verification described under Subscription & Billing applies.
• No subscription charge during the trial. The first subscription charge is taken on day 8, when the trial ends.
• What is charged on day 8 is the price of the plan and billing period you selected, less any promotion code you applied at checkout. If you selected annual billing, the full annual amount is charged at that point.
• Cancel before the trial ends and you are not charged. You keep access for the remainder of the 7 days, and the subscription then ends.
• Your trial end date is shown on your account page while the trial is running.

All sales are final. DealHunter does not offer refunds or prorated credits for partial billing periods, including but not limited to:

• Unused time remaining on your current billing cycle after cancellation.
• Periods of non-use or inactivity.
• Dissatisfaction with search results or alert timing.

Two things fall outside this policy, because no completed sale has taken place:

• The $1.00 card verification described under Subscription & Billing is refunded in full. We issue the refund automatically as soon as the $1.00 clears; in the rare event that the automatic refund does not go through, we complete it manually. Either way you are not charged for the verification.
• If you cancel during your 7-day free trial, no subscription charge is taken at all, so there is nothing to refund.

You may cancel your subscription at any time to prevent future charges.

The Service, including its design, features, code, branding, and all related intellectual property, is owned by Echelon Dynamics Inc. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of your search criteria and user-generated content. By using the Service, you grant us a limited license to process your search criteria solely for the purpose of delivering marketplace alerts.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

• DealHunter does not guarantee the accuracy, completeness, or timeliness of marketplace data or alerts.
• Service interruptions may occur due to maintenance, marketplace changes, anti-bot measures, platform policy changes on third-party sites, or other factors beyond our control. Because DealHunter retrieves publicly available data from third-party marketplace platforms, the accuracy, completeness, and availability of that data depends on those platforms. We are not liable for any resulting losses, including missed deals or delayed alerts caused by third-party platform changes.
• We provide links to third-party marketplace listings but are not responsible for any transactions, disputes, or losses arising from those marketplaces.
• Alert delivery times vary and are not guaranteed.

To the maximum extent permitted by law, Echelon Dynamics Inc.’s total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or loss of business opportunities.

We reserve the right to:

• Issue warnings for minor violations of these Terms.
• Temporarily suspend accounts for repeated violations.
• Immediately terminate accounts for severe or repeated infractions at our sole discretion.

Upon termination, your right to use the Service ceases immediately. You may request deletion of your account data in accordance with our Privacy Policy. Account data deletion requests are processed within 30 calendar days.

We aim to respond to user inquiries within 72 hours. Response times may vary based on volume and complexity of the request.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in the State of Wyoming.

• You waive your right to participate in class-action lawsuits or class-wide arbitration.
• Small claims exception: Either party may bring an individual action in small claims court if the claim qualifies.
• The arbitrator’s decision shall be final and binding.

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.

Any disputes not subject to arbitration shall be filed exclusively in the state or federal courts located in Wyoming.

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
